LIQUIDATOR ambil alih urusan PEMAJU YANG GULUNG TIKAR

1. Apabila sebuah syarikat pemaju telah digulungkan (winding up/wound up), segala hal ehwal, aset dan hutang piutang di ambil alih untuk diurus oleh Liquidator yang dilantik.

“Who can be appointed as liquidator?

Official Receiver (Director General of Insolvency (DGI) in capacity as Official Receiver); or

Private liquidator (an individual person whom is licensed to be a liquidator)”

2. Urusan hartanah yang dahulunya di bawah syarikat yang digulung akan di uruskan oleh “ Liquidator” ini. Antara tugas Liquidator yang uruskan hal ehwal Pemaju yang dah tutup kedai ini adalah seperti :

i. Mengeluarkan surat akujanji dan pengesahan pengesahan seperti siapa tuanpunya dan cagar pada bank mana,bagi pihak Pemaju;

ii. Status permohonan suratan hakmilik hartanah dalam projek perumahan (jika belum ada geran);

3. Ada Liquidator yang tak dapat dokumen sepenuhnya dari syarikat Pemaju. Ada ketika yang kami sebagai Peguam yang perlu bekalkan salinan dokumen kepada Liquidator supaya mereka boleh “ move”.

4. Dokumen pula perlu didapatkan dari Penjual. Kerana itu sangat penting Penjuak simpan semua dokumen berkaitan rumahnya.

5. Kalau Pemaju dah kena gulung dan tak hirau tentang dokumen, mana nak cekau???

6. Ada bayaran perkhidmatan yang kena dibayar pada Liquidator. Antara 1-3% dari harga jualbeli yang baru. Bergantung siapa Liquidatornya.
